Privacy Policy

This policy covers how we use your personal information. We will not sell or rent your personally identifiable information to anyone. We take your privacy SERIOUSLY and will take all measures to protect your personal information.

What Information do we collect?

We collect information that we need that is related to any online orders. This includes your:

  • billing address
  • shipping address
  • email address

If you visit the BYO Shade website, your web-browser automatically discloses, and our web-server automatically logs, the following information:

  • the date and time
  • the IP address from which you issued the request
  • the type of browser and operating system you are using
  • the URL of any page that referred you to the page
  • the URL you requested
  • and whether your request was successful

How Is My Information Used?

Apart from otherwise mentioned in this privacy policy, your information is only used to fill any orders you make online. We will not disclose your personal information to any other person or organisation unless one of the following reasons apply:

  • we are required by law to do so
  • that person or organisation is providing a service to Shade My Chair Pty Ltd and is required to maintain the same or similar privacy legislation principles

Security and Storage

Only your order data, billing and shipping information is stored on our server. Data transmitted on our shopping cart pages is encrypted using a secure 256Bit SSL certificate. Order payments are processed through PayPal secure system. For more information on PayPal security refer to the PayPal website. We do not record or store your credit card data.

Shade My Chair Pty Ltd owns or licenses all content on this website and we assert our right to be recognised as the author of original material on this website.

Shade My Chair Pty Ltd supports the sharing of information and the use of the website content for the purposes of private study, research, criticism or review, as permitted under copyright legislation. However, you are not permitted to reproduce or reuse content on this website for commercial purposes.

The site also includes registered trademarks and trademarks which are the subject of pending applications or which are otherwise protected by law in connection with the site and products. You may not use Shade My Chair or B.Y.O Shade trademarks or the names: Shade My Chair, shademychair.com, shademychair.com.au, BYOshade, BYOshade.com, BYOshade.com.au, or DIYshade.com without our prior written consent.

Despite our best efforts, Shade My Chair Pty Ltd and B.Y.O. Shade make no warranties that the information in this publication is free of infection by computer viruses or other contamination.

We disclaim all responsibility and all liability (including through negligence) for all expenses, losses, damages and costs you might incur as a result of the information on this website or any linked website being inaccurate or incomplete.

 

Returns and Refunds Policy

Currently we are not able to give refunds or exchanges if you simply change your mind about a product you have purchased once you receive it from us. For purchases made through a supplier, you are to contact the supplier as your initial course of action.

If you place an order with us and then change your mind before it has been dispatched to you however, we can offer you a full refund less a cancellation fee, according to the following conditions (if we have already dispatched your order and you then inform us of your wish to cancel your order, this option does not apply):

If paying by Paypal, we will offer a full refund of the order total (including any postage you may have paid when placing your order with us) less a 10% order cancellation fee. This refund will be made via PayPal. For more information on PayPal refunds refer to the PayPal website

If payment has been received by cheque or bank transfer the order cancellation fee is 5% of the order total (including any postage you may have paid when placing your order with us) and will be made by cheque or bank transfer accordingly.

If the goods you receive from us are faulty however, we offer you either a full refund or exchange.

In the instance that we are unable to dispatch an order to you within the timeframe stated when placing your order and you then decide to cancel your order as a result, the cancellation fee will not apply.

  • In the case of a full refund for faulty goods, the full product purchase price (excluding any postage you may have paid when placing your order with us) will be refunded via the same method payment was received (PayPal, cheque or bank transfer)
  • In the case of an exchange, a replacement product will be sent to you within 28 days of receipt of your faulty product.
  • In both instances, you are responsible for the postage cost incurred when returning the faulty product  to us, however in the instance of an exchange, we will pay the postage cost when sending the replacement product to you. All products believed to have a fault must be returned to us within 21 days of notifying us of the fault. Upon receipt of the returned product we will assess its condition before authorising a refund or exchange.
  • Please note that while we take the utmost care in packaging your product, we are not liable for any breakages or damage that occurs to your product during shipping. If you are requesting an item to be shipped overseas (i.e. outside Australia) it is your responsibility to check with your local customs service if there is any doubt regarding the importation of a particular product to your country of domicile. We do not offer refunds or replacements as a result of local customs seizing your products.
  • When returning a faulty product to us, please provide a contact name and phone number / email address we can use to contact you in the event of a query with your product. Please note that at this stage we are only able to contact you by phone if you are within Australia. If you are returning a product from overseas, please provide us with a contact email address to use instead. Please also indicate clearly the reason for returning the product to us, whether you would prefer a full refund or exchange, and include your original tax invoice / receipt.
  • In the case of an exchange we will generate a new tax invoice / receipt and return this to you with your original tax invoice / receipt when sending the replacement product to you.
  • In the case of a full refund, we will generate a refund invoice / receipt and return this to you by post with your original tax invoice / receipt.
  • In some instances it may not be possible to offer you a replacement product if the product is out of stock or discontinued. In this instance you will be entitled to a full refund instead (excluding any postage you may have paid when placing your order with us).

Payment Policy

Accepted Methods of Payment

- All accepted PayPal methods (e.g. credit card)
- Cheque / Money Order
- Bank transfer (please email us to arrange)

All payments are charged in Australian dollars when you place your order. PayPal will automatically adjust payment to Australian dollar. If we are not able to fulfil your order for any reason you will be refunded via the same method used for payment (PayPal, cheque or bank transfer).

Delivery Policy

Turnaround

All orders are dispatched within two working days of clearance of payment (standard cheque clearance times apply).

Order Tracking

If a tracking number is provided by the shipping carrier, we will update your order with the tracking information. Please note that standard Australian post and some other orders will not have tracking numbers.

Shipping Costs

To keep shopping costs to a minimum we have fixed our costs based on the weight of your order, and your location. Before the final checkout page you will be shown what the cost of shipping will be. Our shipping charges can also be found here.

Terms and Conditions

Your access to and use of the site, including your order of products through the site, is subject to these terms, the B.Y.O. Shade Privacy Policy, the Returns and Refunds Policy, the Disclaimer, the Delivery Policy and the Copyright and Trade Mark Policy (together, "Terms and Conditions").

Please read the Terms and Conditions carefully before accessing or using the site. If you are under 18 years of age, you must obtain a parent / guardian's consent before using the site.

The Terms and Conditions constitute a legally enforceable agreement with B.Y.O. Shade and Shade My Chair Pty Ltd. By accessing and using the site you agree that your access and use of the site, including any orders for products made by you through the site, is governed by the Terms and Conditions.
